96.5 KOIT Cat of the Year- Official Contest Rules

These contest rules are specific to the above contest conducted by Entercom California, LLC dba Entercom San Francsico/KOIT-FM (“Station”).  Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well.  A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 201 Third Street, Suite 1200, San Francisco, CA 94103 during regular business hours and on the contest page on the Station’s website at - www.koit.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.

1. NO PURCHASE NECESSARY OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. 
2. The contest entry period will begin at 12:00am (PST) April 14th, 2014 and end at 9:59 am (PST), April 28th, 2014.

3. Persons eighteen (18) years of age or older wishing to enter this Contest (each an “Entrant”), must go to  www.koit.com and click on the graphical “96.5 KOIT Cat of the Year” entry link.

4. The entry/registration process will require you to either log into an existing account, or create a free account with the game administrator, UPICKEM. You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s name, address, phone number and e-mail address. Limit one registration per e-mail address and limit one qualified entry per registration. Multiple entries from the same email will be discarded. Only the first chronologically qualified entry will be considered. All subsequent entries will be discarded.

5. Click on the “Upload Photo” tab and:

• Submit only one (1) photograph of your cat, and only your cat (no people or other animals), in either the “.jpeg” or “.jpg” file format (no other formats will be accepted),
• Enter your cat’s first name and the town/city where you live and your name.
• Affirmatively check the box or “I agree” button, expressly confirming the following:
• Entrant represents and warrants that he/she is both eighteen (18) years of age or older and a California resident.
• Entrant represents and warrants that they are the owner of the cat depicted in the photo. Station is under NO OBLIGATION to verify whether the entrant who submitted the photograph (or winner if selected as the winning entry in this contest), is or is not the legal owner of the pet depicted in the photograph.
• Entrant represents and warrants that he/she own the rights to, or has obtained permission to use, the photo submitted with the entry. 
• Entrant represents and warrants that he/she authorizes Station to post the photo on Station’s website or social network sites or use the photo in any other way Station sees fit.
• Entrant agrees and acknowledges that Station, all contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors: may use the Entrant’s name, image, photo submission, other entry materials and/or biographical information for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation.
• Entrant understands and agrees that Station shall be the sole and exclusive owner of the photo submitted, whether or not the photo is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.
• By submitting a photo in a Station contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable contest rules prove to be false or inaccurate.
• Entrant acknowledges and agrees that the contest rules are available to him/her at www.koit.com , that he/she has had an opportunity to review them before entering this contest, and agrees to be legally bound by the contest rules.  Contest rules are also available Monday through Friday (excluding holidays) during normal business hours between 8am (PST ) and 5pm (PST) at the Station’s studios located at 201 Third Street, Suite 1200, San Francisco, CA 94103

6. Photo requirements:
1. For purposes of this contest, the terms "photo" or "photograph" may be used interchangeably to include, but not be limited to the inclusion of, any image that may be produced by an analog or digital camera, by an optical image scanner (or simply, "scanner"), by means of a "screen dump," "screen capture," "screenshot," or "screengrab," and/or by the digital manipulation of one or multiple photographs such as may be achieved using image editing software.
2. The photo must be uploaded in either the ".jpeg" or ".jpg" file format (no other formats will be accepted), using the method described in Section 5 above.
3. Photo entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the Entrant, or the Station, or a Contest Sponsor.  The foregoing is not intended to require Station to disqualify entrants who, in Station's sole discretion, appear to be innocently wearing clothing or are in areas that just happen to contain third party logos or marks.  Further, Station may, but is not obligated to pixilate/cover any trademarks/servicemarks/copyrighted materials in Station's sole discretion.
4. Only one (1) photo may be submitted for entry in this contest 1) by any one (1) Entrant who must be both eighteen (18) years of age or older and the owner of the cat depicted in the photo, and 2) depicting only their one (1) cat.
5. If you have more than (1) cat, you will only be able to enter (1) cat in the contest.
7. No person or other animal (other than the one (1) cat depicted) may be depicted in any way in the photograph (not even the entrant), and by entering this Contest, the Entrant consents to use of the photograph by Station in any manner it sees fit with no compensation to the Entrant.  Any photograph with any other person(s) or animals depicted in it, no matter how far away or obscure, will be deemed ineligible and thereafter disqualified. 

8. By entering this Contest, the Entrant consents to use of the photograph by Station in any manner it sees fit with no compensation to the Entrant. 

9. Each Entrant may submit only one (1) entry per email in this contest and Entrant must be the owner of the cat depicted in the photo. Station is under NO OBLIGATION to verify whether the entrant who submitted the photograph, selected as the winning entry in this contest, is or is not the legal owner of the pet depicted in the photograph.  Station will discard multiple entries from the same Entrant (whether containing photos of the same or of different cats) and only the first qualifying entry received will be eligible to participate.

10. Station will discard multiple entries received by same Entrant in Contest, whether photograph submitted as entry is of the same or of a different cat, and only the first qualified entry to be received by Station, in chronological order, from particular Entrant will be eligible for entry in Contest. 

11. By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted.  Entrants waive any right to make any claim against Station or any contest sponsors with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry. 

12. By submitting a photo to the Station for this contest, each Entrant authorizes the Station to post such photo to the Station’s website at www.koit.com.  Station will not post all entry photos received on the Station’s website. 

13. Photograph entries must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. Photograph entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the entrant, the Station, or a Contest Sponsor.  BY ENTERING THIS CONTEST AND SUBMITTING PHOTOGRAPH, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH PHOTOGRAPH WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS.  By submitting a photo, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.

14. The Grand Prize Winner will be determined in the following manner:
1. At approximately 10:00am (PST) on April 28th, 2014, Station will post photos of all eligible entries online at the Station’s website,  www.koit.com. Listeners will then be able to vote for their favorite cat from among all photo entries posted online as many times as they wish  (subject to Station’s right to implement limits as set forth in the general contest rules) until 11:59pm (PST) on May 9th, 2014.  LISTENER VOTES WILL NOT BE A DETERMINING FACTOR IN THE SELECTION OF QUALIFIERS BUT MAY BE, IN STATION’S SOLE DISCRETION, ONE OF MANY FACTORS TAKEN INTO CONSIDERATION IN SELECTING QUALIFIERS.

15. After 12:00PM (PST) on  May 9 2014, Station staff and/or management will select the potential grand prize winner from among the Qualifiers, based on evaluation of the submitted photo (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable, subject to verification of eligibility and compliance with these contest rules. Station judges may take the number of votes received into consideration (but is not obligated to) but voting will not be a determining factor in the selection of the winner. 

16. Station will announce the name of the grand prize winner on-air at approximately 7am (PST) on May 12, 2014. The potential grand prize winner need not listen in order to win. Station will contact the potential grand prize winner.  Should the potential grand prize winner not meet the eligibility requirements or is disqualified for any other reason, an alternate grand prize winner may be selected by Station, but in the event such alternate grand prize winner does not meet eligibility requirements or is disqualified, no grand prize will be awarded in this Contest.

17. Station will only award one (1) Grand Prize in this contest. The Grand Prize is valued at approximately $1000, and consists of the following:

18. The prize will be awarded to the verified Entrant only. 

19. The sponsors of this contest are Halo Pet Food and Entercom California, LLC dba Entercom San Francisco/KOIT-FM

20. Station is conducting this contest using proprietary software owned by a third party known as Second Street Media Inc. (“UPICKEM”).  UPICKEM is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to UPICKEM’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “UPICKEM Policies”) and may be required to register with UPICKEM.  While agreement to the UPICKEM Policies is required in order to enter this contest, the UPICKEM Policies are not a part of these contest rules but are a separate agreement between the entrant and UPICKEM.  With respect to the conduct of this contest by Station, in the event of any conflict between the UPICKEM Policies and the Station contest rules, the Station’s contest rules govern.

21. Station is not responsible for any error or technical malfunctions associated with the UPICKEM site that may affect any entrant’s ability to enter, win, or be properly considered in this Contest, regardless of the cause. In the event of a malfunction associated with the UPICKEM site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances. Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.

22. Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible to win in this Contest.   

No purchase necessary. One valid entry per contestant.

You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.

Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If we cannot find an eligible winner for the prize, that prize will not be awarded.

Odds of winning depend on the number of eligible entries received.

Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.

Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.

We reserve the right to substitute any prize with another prize of equal or greater value.

We reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.

Employees of ours, our respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.

Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.

Entrants further grant to us the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.

We reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.

The Contest and all of the related pages, contents and code are copyright, UPICKEM, and us. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.

Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.

We and UPICKEM are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.

All results posted are unofficial until winners respond to e-mail notification.

Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.

This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.

We reserve the right to change the rules at any time.
